Terms & Conditions for Specials & Deals Namibia

1. Introduction and Acceptance of Terms

Welcome to Specials.na (the “Platform”, “Website”, or “Service”), operated by Specials Namibia (Pty) Ltd (“we”, “us”, or “our”), a company registered under the laws of the Republic of Namibia.

By accessing or using the Specials.na website located at https://specials.na, including all features, content, and services available through it, you (“User”, “you”) agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully before using the Platform.

If you do not agree to these Terms, you must immediately cease using the Platform. Your continued use of the Platform constitutes acceptance of these Terms and any updates thereto.

2. Description of Service

Specials.na is an online platform that aggregates and publishes promotional specials, deals, catalogues, and discount information from various third-party retailers and businesses operating in Namibia. The Platform serves as a convenient information hub enabling users to:

Browse current promotional catalogues and special offers from Namibian retailers
View expiry dates and terms of individual promotions
Search for deals across multiple product categories
Access retailer listings and business information
Subscribe to alerts and notifications for new specials

Specials.na does not directly sell goods or services. All transactions, purchases, and commercial interactions occur directly between you and the relevant retailer or business listed on the Platform.

3. User Eligibility

By using the Platform, you represent and warrant that:

You are at least 18 years of age, or accessing the Platform under the supervision of a parent or legal guardian
You have the legal capacity to enter into binding agreements under the laws of Namibia
You are not prohibited from using the Platform under any applicable laws or regulations
All information you provide to us is accurate, current, and complete

4. User Accounts and Registration

Certain features of the Platform, such as subscribing to newsletters, saving favourites, or adding business listings, may require you to create a user account.

4.1 Account Creation

When creating an account, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Account Security

You must notify us immediately at any contact address provided on the Platform if you become aware of any unauthorised use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with this obligation.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we believe you have violated these Terms or for any other reason we deem appropriate.

5. Accuracy of Promotional Information

Specials.na endeavours to provide accurate and up-to-date promotional information. However, please note the following important limitations:

All promotional content, prices, and availability are supplied by the respective retailers and third-party businesses and are subject to change without notice
Specials.na does not independently verify the accuracy, completeness, or currency of any promotional information displayed on the Platform
Prices displayed on the Platform are indicative only and may differ from prices in-store or at point of sale
Availability of products and promotional offers may vary by location and store branch
Promotions are subject to the terms and conditions set by the individual retailers, including stock limitations

You should always confirm pricing, availability, and current offer terms directly with the retailer before making any purchase decision. Specials.na accepts no liability for any discrepancy between information displayed on the Platform and actual in-store conditions.

6. Third-Party Content and Retailers

The Platform contains content sourced from and links to third-party retailers, businesses, and websites. Specials.na:

Does not endorse, control, or take responsibility for the content, products, services, privacy practices, or business conduct of any third-party retailer or advertiser
Is not a party to any transaction between you and a third-party retailer
Has no responsibility or liability for any loss, damage, or dispute arising from your dealings with third-party retailers

Your interactions with third-party retailers are governed solely by the terms and conditions, privacy policies, and other applicable policies of those retailers. We encourage you to review those policies before making any purchase.

7. Intellectual Property Rights

7.1 Our Content

All content on the Platform that is created by or belongs to Specials.na — including but not limited to the Platform’s design, layout, logos, graphics, text, and software — is the intellectual property of Specials Namibia (Pty) Ltd and is protected under applicable Namibian and international intellectual property laws.

7.2 Third-Party Content

Retailer catalogues, images, trademarks, and other promotional materials displayed on the Platform remain the intellectual property of the respective retailers and their licensors. Specials.na displays this content with the permission of or pursuant to arrangements with those retailers.

7.3 Restrictions

Without our prior written consent, you may not:

Copy, reproduce, modify, distribute, or create derivative works based on Platform content
Use any data mining, scraping, or automated data extraction tools on the Platform
Use any Platform content for commercial purposes
Remove or alter any copyright or proprietary notices on Platform content

8. Prohibited Conduct

When using the Platform, you agree not to:

Violate any applicable Namibian or international laws or regulations
Submit false, misleading, or fraudulent information
Impersonate any person or entity
Interfere with, disrupt, or damage the Platform’s infrastructure or security features
Upload or transmit any viruses, malware, or other harmful code
Collect, harvest, or aggregate personal information of other users without their consent
Use the Platform to send unsolicited communications (spam)
Attempt to gain unauthorised access to any part of the Platform or its associated systems
Use the Platform in any manner that could overburden or impair the Platform’s performance

9. Business and Retailer Listings

If you are a business or retailer who submits promotional content, catalogues, or listings to the Platform (“Listing Partner”), the following additional terms apply:

You grant Specials.na a non-exclusive, royalty-free licence to display your promotional content on the Platform
You represent and warrant that you hold all necessary rights to the content you submit
You are solely responsible for the accuracy, legality, and completeness of your promotional content
You agree to ensure that your submitted promotions comply with all applicable Namibian consumer protection and advertising laws
Specials.na reserves the right to reject, remove, or modify any listing that it deems inappropriate, inaccurate, or in violation of these Terms

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information when you use the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

We process personal information in accordance with the Protection of Personal Information Act (POPIA) and applicable Namibian data protection laws.

11. Disclaimers and Limitation of Liability

11.1 “As Is” Basis

The Platform and all content thereon are provided on an “as is” and “as available” basis without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11.2 Availability

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the Platform at any time without notice.

11.3 Limitation of Liability

To the fullest extent permitted by Namibian law, Specials Namibia (Pty) Ltd, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or relating to:

Your use of or inability to use the Platform
Any inaccuracy in promotional information displayed on the Platform
Any transaction or interaction between you and a third-party retailer
Any unauthorised access to or use of our servers or personal information stored therein
Any technical failures, errors, or interruptions of the Platform

12. Indemnification

You agree to indemnify, defend, and hold harmless Specials Namibia (Pty) Ltd and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

Your access to or use of the Platform
Your violation of these Terms
Your violation of any rights of a third party
Any content you submit to the Platform

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Namibia. Any dispute arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Namibia, and you consent to such jurisdiction.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
